BYOM AS is a Norwegian limited company (Aksjeselskap) registered in the Norwegian Register of Business Enterprises (Foretaksregisteret).
BYOM AS offers the following services. Prices are stated in Norwegian kroner (NOK) with a converted euro amount (EUR) in brackets for reference. The euro amount is indicative, not binding. Invoices are issued in NOK, or in EUR for clients based in Germany or Austria.
One (1) individual session. Price: 1,600 NOK (approx. 150 EUR).
One (1) session for two people. Price: 1,900 NOK (approx. 180 EUR).
Ten (10) individual sessions. Price: 14,400 NOK (approx. 1,350 EUR). Valid for 12 months from the date of purchase. Unused sessions expire after 12 months, see § 7.4.
Four (4) individual sessions per month. Availability by email or message with a response within 48 hours between sessions. Minimum commitment: 3 months. Price: 12,300 NOK per month (approx. 1,150 EUR).
Intensive support during an acute crisis phase. Weeks 1 to 6: two sessions per week. Weeks 7 to 12: one session per week. Availability with 24-hour notice. Four crisis coaching sessions included. Total package price: 41,600 NOK (approx. 3,900 EUR).
A single bookable session for acute situations, up to two (2) hours. Price: 3,700 NOK (approx. 350 EUR). For clients with an active package (§ 2.4 or § 2.5): 2,700 NOK (approx. 250 EUR).
BYOM AS is not an emergency service. In an acute emergency, please contact the relevant emergency services immediately. European emergency number: 112. Norway: medical emergency 113, Mental Helse 116 123, police 112. Germany: emergency 112, telephone counselling 0800 111 0 111 (free, 24h). Austria: ambulance 144, telephone counselling 142. International crisis lines: findahelpline.com. BYOM AS cannot replace emergency services.
Invoices are issued in NOK. For clients in Germany and Austria, invoices are issued in EUR. The EUR amounts stated in § 2 are indicative when invoiced in NOK; they are the binding amount when invoiced in EUR.
Payment is made by invoice issued by BYOM AS. The invoice is sent by email after the session, or for packages no later than 48 hours before the first session. The payment deadline is stated on the invoice.
BYOM AS is a Norwegian company and is not registered for VAT in Germany, Austria, or other EEA member states outside Norway. No VAT is charged on services to private individuals. The prices stated are total prices inclusive of all charges.
Price changes are notified in accordance with § 17.
BYOM AS provides coaching, counselling and psychosocial support. Karin Gutenbrunner Byom holds a Diploma in Life and Social Counselling (Dipl. Lebens- und Sozialberaterin, LSB, Austria).
In Norway, some services are offered under the framework of the Norwegian Alternative Treatment Act (alternativbehandlingsloven, lov 2003-06-27-64). These services are not psychotherapy within the meaning of applicable law in Germany, Austria, the United Kingdom, or any other jurisdiction where psychotherapy is a regulated profession.
Karin Gutenbrunner Byom is not a licensed healthcare professional. The services are not clinical psychotherapy or medical treatment and are not a substitute for medical, psychiatric or licensed psychotherapeutic care.
The services offered by BYOM AS:
If the counsellor assesses during a session that a client needs medical or therapeutic help, the client will be informed and encouraged to contact an appropriate professional.
New clients are offered a short, optional and free introductory telephone call before the first session. The purpose is to clarify whether the services suit the client's needs and to answer practical questions. The introductory call is non-binding and does not constitute a contract.
A binding contract is formed by written confirmation (email) from BYOM AS following a booking of a session or package. The withdrawal period under § 6 runs from the time of the booking confirmation.
Consumers have a right of withdrawal under Norwegian law (angrerettloven 2014-06-20-27) and, where applicable, the laws of their country of residence. EU/EEA consumers retain the mandatory consumer rights of their home country (Art. 6 Rome I Regulation (EC) No. 593/2008).
The withdrawal period is 14 calendar days from the date of contract conclusion (i.e. from the booking confirmation under § 5.2).
To exercise the right of withdrawal, notify BYOM AS (BYOM AS, Skjoldenveien 9, 1832 Askim, Norway, email: karin@byom.com) by a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form in Appendix A of these Terms, but this is not mandatory.
To meet the withdrawal deadline it is sufficient that you send your withdrawal notice before the period expires.
If you withdraw from this contract, BYOM AS will repay all payments received from you without delay and no later than 14 days from the day BYOM AS receives your withdrawal notice. Repayment will be made using the same payment method you used for the original transaction, unless expressly agreed otherwise; you will not be charged any fees for this repayment.
If you requested that services begin during the withdrawal period, you are required to pay a proportionate amount corresponding to the services already provided up to the time you notify BYOM AS of your withdrawal.
The right of withdrawal lapses for a service contract once BYOM AS has fully performed the service and performance began only after you gave your explicit consent and confirmed your knowledge that you would lose your right of withdrawal once the contract was fully performed.
On a valid withdrawal, amounts paid are refunded within 14 days, less any proportionate claim under § 6.4.
Cancellations must be made at least 24 hours before the scheduled time. For late cancellations or missed sessions, the full session price is charged.
The minimum commitment is 3 months. Termination is possible at the earliest at the end of the minimum period, with written notice at least 4 weeks before the end of that period. If the contract continues beyond the minimum period, a notice period of 4 weeks applies from receipt of written notice.
The crisis package runs for 12 weeks from the start date and cannot be cancelled during the fixed term. Individual sessions within the package may be cancelled under § 7.1. The right of withdrawal under § 6 applies for 14 days from the booking confirmation, provided no session has begun in that period.
The 10-session package cannot be cancelled, but individual sessions may be cancelled under § 7.1. Unused sessions are valid for 12 months from the purchase date and expire without a right to refund after that date. The right of withdrawal under § 6 applies for 14 days from the purchase date, provided no session has begun in that period.
Unused sessions within an ongoing support package (§ 2.4) do not carry over to the following month and expire at the end of each calendar month, except for sessions cancelled by BYOM AS, see § 8.3.
Sessions purchased as part of the 10-session package are valid for 12 months from the purchase date. Sessions not used within this period expire without a right to refund.
Unused sessions resulting from cancellations by BYOM AS (including illness or force majeure under § 13) are transferred to the next available time or refunded at the client's choice. BYOM AS offers a replacement appointment within 24 hours for short absences, and within 48 hours or in the same week for longer absences. If no replacement can be offered within these timeframes, a refund is offered.
BYOM AS is not an emergency service. In an acute emergency:

Clients are encouraged to contact emergency services directly in case of acute need. BYOM AS cannot replace emergency services.
If BYOM AS assesses during a session that there is an acute risk to the life of the client or others, BYOM AS will actively encourage contact with emergency services and, if necessary, interrupt the session for this purpose.
Karin Gutenbrunner Byom keeps all information arising in the counselling relationship strictly confidential. Information is not shared with third parties without the client's written consent.
Confidentiality does not apply where a statutory duty or right to disclose information exists, including:
The client will be informed where possible if such a disclosure is made.
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR), applicable via the EEA Agreement in conjunction with the Norwegian Act on the Processing of Personal Data (personopplysningsloven 2018-06-15-38).
BYOM AS is the data controller within the meaning of Art. 4(7) GDPR.

You have the right to lodge a complaint with the competent supervisory authority at any time (Art. 77 GDPR). The competent authority is Datatilsynet (Norway), Postboks 458 Sentrum, 0105 Oslo, www.datatilsynet.no. EEA consumers may also contact the supervisory authority in their country of residence.
The European Commission provides an online dispute resolution (ODR) platform, which you can reach at: https://ec.europa.eu/consumers/odr/.
BYOM AS is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration body.
BYOM AS is not liable for failure to fulfil obligations caused by circumstances beyond its control, including illness, pandemic, natural disaster, strike, war, government orders or other extraordinary events.
If BYOM AS must cancel sessions due to force majeure, the client will be offered a replacement appointment within 48 hours or in the same week. If this is not possible, the client will receive a proportionate refund for sessions not carried out. The client chooses between these options within a reasonable time after notification.
BYOM AS is not liable for loss or damage arising from the client's failure to follow advice to seek medical, psychological or emergency services.
BYOM AS is not liable for indirect loss, loss of income, consequential loss or other derivative loss arising in connection with the services, unless the loss results from gross negligence or wilful misconduct by BYOM AS. This does not affect statutory liability for personal injury.
The total liability of BYOM AS towards a client per calendar year is limited to the amount the client has paid for services in the relevant calendar year.
These Terms are governed by Norwegian law.
For consumers resident in an EU/EEA state, the mandatory provisions of the law of their country of habitual residence remain unaffected (Art. 6(2) Rome I Regulation (EC) No. 593/2008). The choice of Norwegian law does not deprive such consumers of the protection afforded to them by the mandatory provisions of their home country law.
Disputes between BYOM AS and clients will first be sought to be resolved by negotiation. If this is unsuccessful, the competent court is Indre Oestfold tingrett, Norway (tvisteloven § 4-4).
Consumers resident in the EU/EEA may bring a claim before the courts of their own place of domicile (Lugano Convention of 30 October 2007, Art. 13 to 15). These Terms do not remove this right from such consumers.
BYOM AS reserves the right to amend these Terms. Material changes will be notified to the client in writing (email) with at least 30 days' notice before taking effect.
If the client does not accept the changes, the client has the right to terminate the contract with immediate effect during the notice period, with a proportionate refund for prepaid and undelivered services.
Continued use of the services after the changes take effect will be deemed acceptance of the new Terms.
